Terms of Service

These Terms of Service ("Terms") govern your use of services provided by Guardova Home, a division of Swift & Associates Ventures Corp ("Guardova Home," "Company," "we," "us," or "our"). By requesting, scheduling, purchasing, or using our services, you agree to these Terms.
1. Description of Services
Guardova Home provides year-round home oversight services, which may include scheduled home visits, general home observations, selected basic maintenance tasks, service notes, condition photos, system diagnostics support, home condition reports, home valuation reports, and coordination or referral to third-party service providers.
Guardova Home is not a licensed general contractor, inspector, engineer, plumber, electrician, HVAC contractor, roofer, mold assessor, pest control company, insurance adjuster, or appraiser unless expressly stated in writing for a specific service. Our services are observational, preventive, administrative, and supportive in nature and are not a substitute for licensed professional inspections, appraisals, estimates, repairs, remediation, or code compliance evaluations.
2. Access to Property and Adult Presence
By scheduling or permitting a service visit, you authorize Guardova Home representatives to enter the property and access reasonably necessary interior and exterior areas for the purpose of performing agreed services.
- An individual age 18 or older must be present at the residence during the visit unless alternative arrangements are approved by Guardova Home in writing.
- You are responsible for ensuring safe, timely, and reasonable access to the property.
- You are responsible for securing pets and notifying us in advance of alarms, gates, lock issues, tenants, or other access restrictions.
- You must disclose known hazards or conditions that may affect service, including but not limited to structural weakness, exposed wiring, leaks, mold, asbestos, lead-based paint, pest infestations, unsafe flooring, aggressive animals, or other dangerous conditions.
We may refuse, stop, or reschedule service if access is restricted, if conditions are unsafe, or if the property is not reasonably suitable for the requested services.
3. Client Responsibilities and Property Preparation
You agree to provide a safe and reasonably accessible environment for each visit. This includes removing barriers to access, securing pets, and disclosing any special instructions that may affect service.
- You are responsible for the accuracy of the information you provide to Guardova Home.
- You are responsible for informing us of known pre-existing damage, fragile materials, defective systems, or site conditions that could affect service.
- You are responsible for ensuring the property is safe for normal entry and movement during the visit.
4. Scope and Limitations of Services
Guardova Home services are limited to general observation, selected basic maintenance, documentation, and practical support. We do not open walls, dismantle systems, perform destructive testing, guarantee diagnosis of hidden conditions, or guarantee prevention of future failures.
- Our observations are based on conditions visible and accessible at the time of service.
- We do not guarantee that every condition, defect, or future issue will be discovered.
- Our services are intended to help reduce risk and improve homeowner awareness, not eliminate all risk.
5. Condition Reports, Photos, and Home Valuation
Any notes, photos, reports, or summaries we provide are based on observations made during the visit and are not guarantees, certifications, warranties, or formal inspections.
Condition reports are informational only and should not be relied upon as a substitute for evaluations by licensed professionals. Home valuation information is an estimate only and should not be relied upon as a formal appraisal, broker price opinion, or guarantee of market value. Market conditions, property changes, local trends, financing conditions, and buyer behavior may materially affect value.
6. Diagnostics and Recommendations
If Guardova Home provides general diagnostic support or recommendations, such information is intended to help the client decide next steps. It is not a warranty, guarantee of cause, or guarantee of repair cost. Clients should confirm all material issues with an appropriately licensed professional before authorizing repair work.
7. Third-Party Referrals and Independent Providers
Guardova Home may refer or connect you with independent third-party providers. Those providers are not employees, agents, or legal representatives of Guardova Home unless expressly stated in writing.
- We do not control or guarantee the work, pricing, schedule, quality, licensing, insurance, or availability of third-party providers.
- Any agreement for third-party services is solely between you and that provider.
- Any disputes regarding third-party work, billing, delays, or damage must be handled directly with that provider.
8. Rental Property and Occupied Property Services
For rental or occupied properties, you represent that you have authority to authorize services at the property. You are responsible for obtaining any tenant permissions, notices, or consents required by law or lease agreement. Guardova Home is not responsible for disputes between owners, managers, tenants, occupants, associations, or neighbors arising from access or service scheduling.
9. Scheduling, Rescheduling, and Weather Delays
Service visits are scheduled based on availability and may be adjusted due to weather, safety concerns, property access issues, staffing, or operational needs.
- We may reschedule visits when conditions make service unsafe or impractical.
- We are not liable for losses, inconvenience, or delays caused by schedule changes.
- If a client causes a missed appointment or prevents reasonable access, the visit may be rescheduled and may be subject to a trip charge or no-access fee if disclosed in your service plan or invoice.
10. Service Concerns and Inspection Period
You agree to review completed services promptly and notify Guardova Home in writing of any specific concern within twenty-four (24) hours after the visit, or within a longer period if required by law. Failure to notify us within that period may limit our ability to review the concern.
11. Payments, Fees, and Subscription Terms
If you purchase services individually or through a monthly or recurring plan, you agree to pay all applicable fees, taxes, trip charges, materials approved by you, and any authorized service-related charges.
- Recurring plans may renew automatically unless canceled in accordance with your service agreement.
- You authorize Guardova Home to charge the payment method on file for recurring and one-time authorized charges.
- You are responsible for maintaining valid and current payment information.
- Late or declined payments may result in suspension or termination of service.
Unless otherwise required by law or stated in writing, payments already earned for scheduled or completed services are non-refundable.
12. Cancellation and No-Access Policy
If you cancel, reschedule, or fail to provide reasonable property access on short notice, Guardova Home may assess a cancellation fee, no-access fee, or trip charge if disclosed in your estimate, invoice, subscription terms, or service plan.
13. Communications Consent
By contacting Guardova Home or using our services, you consent to receive service-related communications from us by phone, email, and text message, including scheduling, confirmations, reminders, invoices, service updates, and follow-up communications. You are responsible for obtaining any necessary consent from co-owners, occupants, or authorized representatives whose information you provide to us.
14. Photos, Video, and Documentation
During service visits, Guardova Home may take photos, notes, or other documentation for service records, reporting, quality control, training, and verification of work performed. Interior photos or recordings will be limited to service-related purposes. We will not publicly use identifiable images of your property without your permission except as required by law.
15. Property Conditions, Pre-Existing Damage, and No Guarantee of Outcome
Homes naturally experience aging, wear, deferred maintenance, and unexpected failures. Guardova Home is not responsible for pre-existing defects, concealed conditions, or issues that arise from age, ordinary wear, manufacturer defects, poor prior workmanship, weather, occupancy, misuse, deferred maintenance, pests, moisture intrusion, or other factors outside our control.
We do not guarantee that our services will prevent all breakdowns, leaks, clogs, damage, or loss in value.
16. Limitation of Liability
To the fullest extent permitted by law, Guardova Home shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, loss of use, loss of rental income, loss of business opportunity, business interruption, data loss, or diminution in property value.
Guardova Home shall not be liable for:
- Undetected, hidden, or inaccessible conditions
- System failures occurring before, during, or after a visit
- Damage or loss caused by third-party service providers
- Client failure to disclose hazards, defects, or restrictions
- Client failure to act on observations, recommendations, or referrals
- Weather, natural events, or other causes beyond our reasonable control
To the fullest extent permitted by law, Guardova Home’s total liability for any claim arising out of or relating to services shall not exceed the total amount actually paid by the client to Guardova Home for the specific services giving rise to the claim, or if a court does not enforce that standard, the amount paid by the client during the twelve (12) months preceding the claim, whichever is less restrictive as required by applicable law.
17. Release and Indemnification
You agree to defend, indemnify, and hold harmless Guardova Home, Swift & Associates Ventures Corp, and their owners, officers, employees, contractors, and representatives from and against claims, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- information you provide that is inaccurate or incomplete
- unsafe or undisclosed property conditions
- your breach of these Terms
- your agreements or disputes with third-party providers
- your misuse of reports, valuations, photos, or recommendations
18. Authority to Agree
You represent that you have legal authority to request services for the property, to grant access, and to agree to these Terms on behalf of all owners, occupants, or entities with an interest in the property, as applicable.
19. Privacy Policy
Your use of Guardova Home services is also subject to our Privacy Policy. By using our services, you acknowledge that we may collect, use, and store information in accordance with that policy.
20. Assignment, Severability, No Waiver, and Entire Agreement
You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a sale, reorganization, or transfer of business operations.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver. These Terms, together with any written service agreement, estimate, invoice, or approved proposal, constitute the entire agreement between you and Guardova Home regarding the services described.
21. Changes to These Terms
We may update these Terms from time to time. Updated Terms become effective when posted on our website or otherwise provided to you, unless a different effective date is stated.
